Genuine redundancy is not considered unfair dismissal. A genuine redundancy is when:
- the person's job doesn't need to be done by anyone
- the employer followed any consultation requirements in the award or enterprise agreement
- there was no reasonable opportunity for the person to be redeployed within the employer's business or an associated business. When an employee's dismissal is a genuine redundancy, the employee can't make an unfair dismissal claim.
