Collection-provision of a health service

  • (1) A permitted health situation exists in relation to the collection by an organisation of health information about an individual if:
  1. (a) the information is necessary to provide a health service to the individual; and
  2. (b) either:
  3. (i) the collection is required or authorised by or under an Australian law (other than this Act); or
  4. (ii) the information is collected in accordance with rules established by competent health or medical bodies that deal with obligations of professional confidentiality which bind the organisation.
  5. (1A) A permitted health situation exists in relation to the collection by an organisation of health information about an individual (the third party ) if:
  6. (a) it is necessary for the organisation to collect the family, social or medical history of an individual (the patient ) to provide a health service to the patient; and
  7. (b) the health information about the third party is part of the family, social or medical history necessary for the organisation to provide the health service to the patient; and
