member of a tribunal: (i) that is established by or under a Commonwealth law, or a law of a State or Territory that applies in an external Territory; and (ii) that is prescribed by the regulations for the purposes of this subparagraph. (5A) The Minister may, by legislative instrument, exempt a body, office or appointment for the purposes of paragraph (ca) or (ea) of the definition of agency in subsection (1).
