Various state, territory and federal anti-discrimination laws make it unlawful for an employer to discriminate on the grounds of gender about the terms and conditions of employment offered or provided to employees (which includes pay and other benefits). It's also unlawful under the FW Act to discriminate against an employee because of a protected attribute. This includes sex, sexual orientation, breastfeeding, gender identity, intersex status, marital status, family or carer's responsibilities, pregnancy, or because an employee is (or has been) experiencing family and domestic violence.
