(1) The regulations may provide for a person who is alleged to have committed an offence against the regulations to pay a penalty to the Commonwealth as an alternative to prosecution. (2) The penalty must not exceed one-fifth of the maximum penalty prescribed by the regulations for that offence. Infringement notices for civil penalties (3) The regulations may provide for a person who is alleged to have contravened a civil penalty provision under the regulations to pay a penalty to the Commonwealth as an alternative to civil proceedings. (4) The penalty must not exceed one-tenth of the maximum penalty prescribed by the regulations for contravening that provision.
