(1) The Fair Work Ombudsman may, in writing, appoint as a Fair Work Inspector: (a) a person who has been appointed, or who is employed, by the Commonwealth; or (b) a person who is employed by a State or Territory. (2) The Fair Work Ombudsman may appoint a person as a Fair Work Inspector only if the Fair Work Ombudsman is satisfied that the person is of good character. (3) A Fair Work Inspector is appointed for the period specified in the instrument of appointment. The period must not exceed 4 years. Note: A Fair Work Inspector is eligible for reappointment (see subsection 33(4A) of the Acts Interpretation Act 1901 ).
