(5) The industrial action period is the period: (a) starting at the later of: (i) the start of the first day on which the employee implemented the partial work ban; or (ii) the start of the next day, after the day on which the notice was given, on which the employee performs work; and (b) ending at the end of the day on which the ban ceases.
