(1) If: (a) a named employer award covers the new employer because of paragraph 313(1)(a); and (b) the named employer award covered an employer organisation in relation to the old employer immediately before the termination of a transferring employee's employment with the old employer; 290 Fair Work Act 2009 No. 28, 2009 then the named employer award covers the employer organisation in relation to the new employer.
