A bargaining representative for a proposed enterprise agreement may apply to FWA for a declaration (a serious breach declaration ) under section 235 in relation to the agreement. Note: The consequence of a serious breach declaration being made in relation to the agreement is that FWA may, in certain circumstances, make a bargaining related workplace determination under section 269 in relation to the agreement.
