- (1) This section applies if:
- (a) an employee who is an outworker is covered by an enterprise agreement; and
- (b) a modern award that is in operation and covers the employee includes outworker terms. Agreement must include outworker terms etc. (2) FWA must be satisfied that:
- (a) the agreement includes terms of that kind; and
- (b) those terms of the agreement are not detrimental to the employee in any respect when compared to the outworker terms of the modern award.
